Terms and Conditions of Sale

The conditions of sale are applicable whether read or not.

 

Bidding

A 15% buyer’s premium will be added, and the sales tax will be applied to the total of the bid price and the 15% buyer’s premium. All items are sold on a “final sale as is” basis at the time of purchase, subject to all faults and defects, irrespective of any inspection made by or on behalf of the buyer. Each lot is subject to a reserve and/or minimum bid, and the consignor retains the right to withdraw, divide, or consolidate any lot and reject any bid.

 

Payment Terms:

All lots must be paid in full at the conclusion of the auction, with exceptions at the auctioneer’s sole discretion. In the event of default in payment, the purchaser assumes all collection costs, including reasonable attorney fees. Interest will accrue at a rate of 24% per annum on any outstanding amounts due from the due date until paid. Failure to pay the purchase price or remove items from the auction premises empowers the auctioneer, at their sole discretion, to move items to storage, cancel the sale, and seek legal remedies against the purchaser, including monetary damages for the purchase price. The auctioneer may also choose to resell goods refused by the bidder, holding them responsible for the price difference in the resale. The bidder is additionally liable for costs incurred during such resale, including warehousing and auctioneer’s commissions. All payment and financial invoice information remains confidential. A copy of sales tax exemption certificates and submission of a sales tax exemption form during registration are required to claim sales tax exemption. Invoices are subject to audit for errors, and the bidder is accountable for any balance due. If a sales tax deficiency arises due to incorrect exemption information or for other reasons, the customer authorizes charging the balance to their credit card.

 

Appraisals:

Appraisals furnish item descriptions and assign a retail replacement value for insurance purposes. However, it’s advised not to solely base purchase decisions on appraisal values, as these appraisals are conducted by independent appraisers and may vary. The auctioneer assumes no liability for the appraisal certificates due to the subjective nature of grading and appraising processes.

 

Warranty/Appraisal:

While descriptions are believed to be accurate, statements or representations about items, whether in the catalog or spoken, are opinions and not factual assertions. The auctioneer disclaims all warranties, including fitness for a specific purpose and merchantability, for purchased items. The auctioneer makes no warranty or representation about the value of any item. The auctioneer, consignor, and vendor disclaim all responsibility for authenticity, age, origin, condition, size, weight, quality, or kind. Buyers should satisfy themselves regarding authenticity and condition before bidding. No auctioneer employee is authorized to make factual representations. This warranty’s terms may only be altered in writing, with oral statements having no bearing. Auctioneer statements about goods are not warranties and are not part of the terms and conditions. Any dispute arising under this agreement will be resolved by private, binding arbitration and or local courts of competent jurisdiction in the area where the auction was conducted. Consent to being recorded and/or photographed is hereby granted.

 

Note: Additional terms and conditions, including those related to jewelry certificates, may be presented before the auction. The terms and conditions detailed here will collectively bind the purchaser.
